Waiver and Indemnity

1. The purchaser (You) are digitally signing and consenting to this Indemnity Form Agreement by purchasing from DTECC (pty)Ltd. By consenting the purchaser (You) do hereby irrevocably indemnify and hold harmless DTECC (pty)Ltd against all and any actions, suits, proceedings, claims, demands, costs and expenses of whatsoever nature and howsoever incurred which may be taken or made against DTECC(pty)Ltd.
2.  The purchaser (You) consent to this Indemnity Form by freely accepting and fully understanding all such risks, dangers, hazards and the possibility of personal injury, death, property damage and loss resulting from the misuse of any and all products sold by DTECC (pty)Ltd.
3. The purchaser (You) freely and voluntarily agree to this indemnify and DO NOT hold the Company (DTECC (pty)Ltd), and all of the officials, officers, agents and employees liable from any and all liabilities whatsoever from any and all claims, demands, actions or causes of action for personal injury, including death, or property damage arising from or in any way whatsoever.
4. By entering into this Agreement The Purchaser (You) are not relying upon any oral or written representations or statements made by the Company (DTECC(pty)Ltd) or its agents with respect to the safety of Special Events other than what is set forth in this Agreement.

MINORS

1. Where the Indemnifying Party is a minor (younger than 18 (eighteen) years), the Indemnifying Party agrees to be and has been assisted by a parent/guardian in agreeing to this agreement and such parent/guardian has consented to the Indemnifying Party participating in the Activity. 
2. I, the parent/guardian and or the purchaser (You) of the Indemnifying Party, understand that the Activity is inherently dangerous and may create certain risks to persons that can result in property damage and serious physical injury. I further understand that the Indemnified Party, its
   officers, employees and agents will not be and/or is not responsible for any injuries, property damage or liability that may arise from the Activity. I further assume full responsibility for the decision, and the consequences thereof, to allow my child/the minor (the Indemnifying Party) to take part in the Activity as set forth herein.
3. I, the parent/guardian and or the purchaser (You) do hereby release, agree to indemnify and hold the Indemnified Party, its officers, employees and agents free and harmless from any and all costs, losses, expenses, damages, claims, suits, causes of action or any other liability or responsibility whatsoever, in
   law or in equity, including attorney’s fees and related costs, resulting from any injury to any person(s) or damage to property arising out of, or which may in any manner be connected with, the Activity and my child’s (the Indemnifying Party) participation therein.

GENERAL

1. The purchaser (You) confirm that you fully appreciate the risks that you may be exposed to during your participation in the Activity and that you voluntarily accept such risks.
2. The purchaser (You) hereby consent to the Indemnified Party and its officers, employees, agents and third party service providers lawfully collecting, processing, storing and transferring your personal information, as defined in the Protection of Personal Information Act 4 of 2013
   (POPI) in accordance with POPI and to process such information in insofar as necessary.

Acceptance

By purchasing from DTECC(pty)Ltd The Purchaser (You) HAVE READ AND UNDERSTAND THIS AGREEMENT AND ARE AWARE THAT YOU ARE CONSENTING AND DIGITALLY SIGNING TO THIS AGREEMENT AND ARE WAIVING CERTAIN LEGAL RIGHTS WHICH THE PURCHASER (YOU) OR YOUR HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES
